This Privacy Policy of MeeBoss (the “Policy”) explains how the entities named below (“MeeBoss”, “we”, or “us”) collect, use, store, disclose and share (collectively, “process”) your Personal Data (defined below) when you use our mobile application MeeBoss (the “App”) and our website at meeboss.com (the “Website”), and any software, service, feature, product, and element (including email messages, notifications, and other messages) provided by or on behalf of MeeBoss (collectively, the “Services”). We respect your privacy and will take security protection measures to protect your Personal Data.

The MeeBoss controlling entity responsible for your information will depend on your location. It is important to note that the contracting entity indicated in our Terms of Service may differ from the entity listed as a controller in this Privacy Policy.

a)    For users in Germany or other European Economic Area (“EEA”) countries, the controlling entity is Golden Orion Holdings GmbH;

b)    For users in the United States or the rest of world, the controlling entity is Bullseye Technology LLC.

This Policy may be updated from time to time and therefore please check back periodically for the latest version of the Policy, as indicated below. If there will be any significant changes made to the use of your Personal Data in a manner different from that stated at the time of collection, we will notify you by posting a notice on our Website and/or App, or by other means.

You may hold one or more of the following identities separately or simultaneously:

  • a) When you use the Services to seek for prospective employees, view resumes, profiles, publish job openings (“Job Advertisements”) or communicate with any Job Seeker, on your own behalf or on behalf of or as a representative of a company, you are referred to as a “Recruiter” in this Policy.
  • b) When you use the Services to upload your resume or CV, view Job Advertisements, or services or information related to your personal employment, communicate with any Recruiter, or apply to Job Advertisements, you are referred to as a Job Seeker” in this Policy.

Here is a summary of the information contained in this Policy. This summary is to help you navigate the Policy and it is not a substitute for reading the entire Policy. You can view each particular section for more detailed information.

  • What data do we collect about you? If you register an account to use the Services, we will need some Personal Data from you to set this up which we collect directly from you. We will also collect and create Personal Data about you when you use certain functions of the Services. We use cookies necessary for the provision of our Services, and you may control these cookies in your web browser and through other technologies we may offer. For more information, please refer to section 1: What data do we collect about you?
  • How do we use your data and on which legal basis? We process your Personal Data to manage the contract you have with us and to provide functions related to account management, interaction with other users, and other Services. We also process your Personal Data to identify the abnormal status of our Services, to ensure the stability and security of our Services, and to meet governmental and institutional policy obligations. The legal basis depends on the specific processing purposes and may in particular be the necessity for contract fulfilment, your consent, a legal obligation or a balancing of interests.   • How do we retain your data? Depending on the controlling entity, we will store your Personal Data on servers located in the United States, and we take every reasonable step to ensure that your Personal Data is only processed for the minimum period necessary for the purposes set out in this Policy. For more details on the location and duration of the retention of your Personal Data, please refer to section 3: How do we retain and protect your data?
  • How will we disclose and transfer your data globally? We may disclose your Personal Data to Recruiters, Job Seekers, and some third-party service providers (e.g., IT services and business support) who help us deliver the Services. We may also be required to disclose certain Personal Data about you in response to any legal procedures or requests from regulatory authorities, for audit purposes, in the event of mergers, acquisitions, sale of assets, or transfer of services, and in other circumstances specified in section 4: How will we disclose your data? Due to the international operation of our business, your Personal Data may be accessed from and transferred to jurisdictions outside of where you are located. In the event of a cross-border transfer of Personal Data, we take appropriate measures to provide an adequate level of protection for your Personal Data.   • What are your rights regarding the processing of your Personal Data? Depending on where you are, you have certain rights with respect to your Personal Data, such as rights of access and data portability, to correct or delete your Personal Data, to withdraw your consent, restrict or object to our processing of your Personal Data, or to lodge complaints with an applicable authority if you are of the opinion that our processing is in breach of data protection laws.   • How do we protect minors? We do not aim to provide Services for minors, and we do not intentionally collect or maintain information from minors. For more information, please refer to section 7: How do we protect minors?

1. What data do we collect about you?

For the purpose of this Policy, “Personal Data” means any information relating to an identified or identifiable individual. To the extent that our processing of your Personal Data is subject to certain data privacy protection laws (including, but not limited to the Washington State My Health My Data Act (“MHMDA”), Nevada Revised Statutes and California Civil Code (collectively hereafter “applicable laws”), we will also notify you about the legal basis on which we process your Personal Data and your rights under such laws.

We collect the following categories of Personal Data from you:

1.1. Personal Data you provide to us directly

Personal Data we collect from all users:

  • Account Information: includes your phone number, verification code, personal email address, corporate email address, password, and profile picture.
  • User Interaction Information: includes information you provide when you interact with other users, such as the initial message you sent, your chat history, and the users you have blocked.
  • Feedback Information: includes the feedback and complaints you provide about our Services or other users.

Personal Data we collect from Job Seekers:

  • Job Preference Information: includes the information you provide indicating your preferences, such as your preferred job title, preferred work location, minimum acceptable salary, office location type (such as on-site, hybrid, remote), employment type (such as full-time, part-time, internship), job level (such as junior, senior, expert), preferred industry, and other choices you opt for when you complete your job preference in the Services, and whether you consent to receive recommended job postings via email.
  • Job Seeker’s Profile Information: when you complete your profile as a Job Seeker in the Services, we may collect your name, work experience, highest educational qualification, job role, avatar, contact details (email address, phone number), location (the country and state/city you reside in), postal code, work eligibility status, resume file, profile link from other social media platforms, educational experience, project experience, performance information, languages and fluency, skills, certifications, and other information included in your profile, as well as the visible scope of your profile (including whether it is visible to Recruiters to which you haven’t applied). To assist with the profile completion process, we may also collect your Personal Data from the resume file and/or the link from other social media platforms you provide to us and use this information to complete and enhance your profile, subject to your confirmation.
  • Job Application Information: includes information you provide when you apply for, or save a job in the Services, such as the jobs for which you applied, the jobs you saved, and the resume and contact details (email, phone number) you shared with Recruiters.

Personal Data we collect from Recruiters:

  • Recruiter’s Profile Information: when you complete your profile as a Recruiter in the Services, we may collect your contact details (email address, phone number), verification code, name, job role, company name, company size, industry, company website, and other information included in the Recruiter profile.
  • Job Advertisement Information: when you post a Job Advertisement in the Services, we may collect the job title, employment type (such as full-time, part-time, internship), work location type (such as on-site, hybrid, remote), work location, salary, job description, minimum educational requirement, experience requirement, skill requirement, and other information you included in the Job Advertisement.
  • AI Interaction Information: when you post a Job Advertisement in the Services, you may provide us with the job description and other Job Advertisement Information (“Inputs”), which may be shared with the third-party AI service provider if you choose to use AI editing services. These Inputs will be used by the third-party AI service provider to generate responses (“Outputs”).

1.2. Personal Data collected by automated means:

In order to provide personalized services, to ensure continuous services and to guarantee service quality, we will automatically collect the following Personal Data when you log in and otherwise use the Services:

  • Network and Device Information: IP address, device identification code (Google Advertising ID (GAID), Identifier for Advertisers (IDFA), Identifier for Vendors (IDFV)).
  • Services Usage Information: User ID, registration time, profile completion time, most recent active time, user status (normal/abnormal), whether the profile is complete, login platform, operation system type, browser type, language preference, view history, usage records of functionalities used, number of daily chats, and whether messages have been read.

We may also use the following technologies to collect Personal Data when you access our Services:

  • Cookies and Similar Technologies, which mean text files or other technologies for storing data on your device to uniquely identify your browser or to store information or settings in the browser to help you navigate between pages efficiently, remember your preferences, enable functionality, help us understand user activity and patterns, and facilitate online advertising.

Most browsers accept cookies automatically but allow you to disable them by setting your browser or indicating when a cookie is being sent. However, disabling cookies entirely may limit your access to certain features of the Services. You may learn more detailed information about the cookies we use through our Cookie Policy.

1.3. Personal Data collected From Third Parties

When you use a third-party account to register or log in to our Services via single sign-on (Google, Apple, etc.), we may collect certain information related to your third-party account (“Third Parties Account Information”). The Personal Data that is shared will depend on your social media platform settings and is subject to the policies of the respective providers, which may change from time to time. Please see the data protection information of your single sign-on provider for further information. We also receive Personal Data from social media companies when you interact with that social media company on or in connection with our Services, for example, when you use the URL from other social media platforms to quickly fill or update your profile information or when creating a Job Advertisement using a link from other social media platforms to automatically populate job details.

1.4. Data That You Should Not Provide to Us

MeeBoss does not require any Personal Data related to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, data concerning health, sex, or sexual orientation for the utilization of the Services and will not process any Personal Data that exceeds these specifications if it is received. If you upload your resumes/CVs on MeeBoss or interact with other users, please carefully consider the information that is contained within your resume or any communications and ensure that you are not providing any sensitive or other information that is not necessary for your job application.

 

2. How do we use your data and on which legal basis?

We will only process your Personal Data when permitted under the applicable laws. Our legal basis for collecting and using Personal Data described in this Policy depends on the Personal Data we collect and the specific context in which we collect the information, including when:

  • We need to perform a contract with you;
  • You have given us consent to do so;
  • Processing your Personal Data is in our legitimate interests (without being overridden by your legitimate interests), including:
    • providing, maintaining and marketing our Services;
    • detecting, preventing, and enforcing violations of our Terms of Service including misuse of the Services, fraud, abuse, and other trust and safety protocols; and
    • protecting our legal rights and the rights of others.
  • We need to comply with our legal obligations under applicable laws.

To analyze your use of, and any other interaction or interest in our Services.

We process Personal Data collected or generated automatically during your use of the Services to create anonymized and aggregated data about how users interact with our Services. This data is used solely to identify trends, such as which features are most frequently used, to improve the accessibility and functionality of the Services. The anonymization of the data is the first and only processing activity involving Personal Data in this context. All further analysis is conducted on anonymous data only.

Automated Processing of Your Personal Data

We perform automated processing of Personal Data to evaluate specific aspects of a User and to analyze and predict their preferences and interests. This processing is based on either user consent or performance of contract, as it is necessary for us to provide our services to Job Seekers and Recruiters. For example, automated processing allows us to match Job Seekers with Recruiters effectively, to provide Job Seekers with job alerts and Recruiters with candidate lists by evaluating your interactions on the platform, such as the job descriptions you view or save to (or remove from) your list of saved jobs and using this information when selecting and ranking the jobs that are presented to you in the app.

This processing does not produce legal effects or similarly significant effects on users (e.g., the conclusion of a contract or denial of a service does not depend solely on these processes). The outcomes of the automated processing are intended to improve the user experience by making our services more relevant and tailored to individual needs.

The input data provided by users, such as Profiles and Job Advertisements, along with User Interaction Information, are key factors evaluated by the algorithm to generate recommendations or matches. Further safeguards are in place, as detailed in this Privacy Policy, to protect the privacy of our users.

3. How do we retain and protect your data?

3.1. How long do we store your data?

We adhere to retention policies for the Personal Data we collect to ensure that such Personal Data is not retained longer than necessary for the intended purpose. Different retention periods are applied to each type of Personal Data collected by us in accordance with service needs and regulatory requirements.

Upon expiration of the retention period, we will either delete or anonymize your Personal Data. Measures will be taken to render the Personal Data irrecoverable or irreproducible.

When assessing how long your Personal Data is retained, we consider criteria such as: (i) the nature of the Personal Data and the activities involved; (ii) the time when you use the Services; (iii) how long you use the Services; and (iv) our legitimate interests and legal obligations.

In some circumstances, we will anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use such anonymized data indefinitely without further notice to you.

3.2. How do we protect your data?

We have implemented appropriate technical and organizational security measures designed to protect your Personal Data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, unauthorized access, and other unlawful or unauthorized forms of processing, in accordance with applicable laws. We also have internal procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and Personal Data by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account. If you have any concerns that your account or Personal Data has been put at risk, for example, if someone could have found out your password, please contact us by using the contact details provided in How to contact us below.

Please note, the Internet is an open system, and the transmission of information via the Internet is not completely secure. Although we will implement all reasonable measures to protect your Personal Data, we cannot guarantee the security of your data transmitted to us using the internet – any such transmission is at your own risk, and you are responsible for contributing to the secure transfer of personal data (e.g. by using current browser versions that support the encrypted connections offered by us).

 

4. How will we disclose your data?

We share your Personal Data for lawful, legitimate, necessary, specific, and explicit purposes. We will disclose data to the following categories of third parties for the purposes explained in this Policy:

  • Recruiters. We disclose Job Seekers’ Personal Data to Recruiters for the purpose of selecting and recruiting candidates.
  • Job Seekers. We disclose Recruiter-related information to Job Seekers, in order to help Job Seekers evaluate Job Advertisements.
  • Service providers. We may disclose your Personal Data to third-party service providers who provide us with IT services (such as cloud storage service and real-person verification service) and business support (such as statistical analysis service provider), or otherwise process data on our behalf in connection with our general business operations.  For certain features that rely on artificial intelligence, such as AI editing services or the generation of explanatory summaries in Top Matches, we may disclose relevant input data (including AI Interaction Information, Job Seeker’s Profile Information and Job Advertisement Information) to the third-party AI service provider.
  • Law enforcement agencies, public authorities, or other judicial bodies and organizations. We disclose data (a) if we are legally required to do so, or (b) if we have a good faith belief that such disclosure is reasonably necessary (i) to comply with a legal obligation, process or request; (ii) to enforce our Terms of Service and other terms, policies, and standards, including investigation of any potential violation thereof; (iii) to detect, prevent or otherwise address security, fraud or technical issues; or (iv) to protect the rights, property or safety of us, our users, a third party or the public as required or permitted by applicable laws (including exchanging information with other companies and organizations for the purposes of fraud protection).
  • Change of corporate ownership. If we are involved in a merger, acquisition, bankruptcy, reorganization, partnership, asset sale or other transaction, we may disclose your Personal Data as part of that transaction only as far as necessary with regard to the respective recipient in consideration of the progress and respective state of the (planned) transaction.

 

5. How will we transfer your data around the world?

Your data will be processed on servers located in the United States. However, due to the international nature of our business, your Personal Data may also be transferred to third-party service providers and business partners, in connection with the purposes set out in this Policy. For this reason, we transfer Personal Data to other jurisdictions that may have different laws and data protection compliance requirements to those that apply in the jurisdiction in which you are located.

 

6. What are your data subject rights and choices?

Subject to applicable law and depending on where you reside, you have rights regarding your Personal Data, as described further below. If you want to exercise your rights or if you have any other requests relating to the processing of your Personal Data, please contact us by using the contact details provided in How to contact us below.

6.1. Data Access

You have the right to know what Personal Data we process about you, including the categories of Personal Data, the business or commercial purposes for collection, and the categories of third parties to whom we disclose it and other information according to the applicable law by contacting us. You are able to access much of your Personal Data by viewing it directly in your account.

6.2. Data Correction

You have the right to request that we correct inaccurate Personal Data that we retain about you, subject to certain exceptions. You can modify much of your Personal Data by editing your account profile information directly.

6.3. Data Portability

You may contact us to request the Personal Data you have provided to us in a structured, commonly used and machine-readable format and have it transferred to another controller, to the extent required by applicable law.

6.4. Data Deletion

You have the right to delete your account and erase your Personal Data. Upon deleting your account, all your Personal Data will be deleted in due course from our systems. Additionally, you may also request deletion of the Personal Data you provided by contacting us. If some of your Personal Data cannot be deleted, we will inform you of the reasons for not taking action.

Please note that we reserve the right to retain some of your Personal Data where there are valid grounds for us to do so under applicable laws.

6.5.  Withdrawal of Consent

Where we process your Personal Data on the basis of your consent, you may withdraw your consent by contacting us. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

6.6. Objection to the Processing

Subject to applicable laws, you may object to the processing of your Personal Data based on our legitimate interests where there are grounds relating to your particular situation by contacting us. Please note that we may have an overriding legitimate interest to keep processing your Personal Data, but we will let you know where this is the case.

Specifically, we may engage in automated processing and profiling to provide Job Seekers with Job Advertisements in which they may be interested. Therefore, you may object to such processing and profiling by contacting us.

6.7. Restrictions to Processing

If you would like to restrict our processing of your Personal Data, you may contact us. Depending on your jurisdiction, you may have the right to restrict the processing of your data where one of the following applies:

  • the processing is unlawful and you oppose the erasure of relevant Personal Data;
  • for the purpose of establishment, exercise, or defense of legal claims, you request us to retain your Personal Data that we were supposed to delete;
  • your objection regarding the accuracy of your Personal Data is pending our verification;
  • your request to object to the processing of your Personal Data is pending our verification.

6.8. Other Rights

Depending on your jurisdiction, you may be entitled to additional rights in relation to your Personal Data. For example, for United States residents, please find more details of your rights in Section 8 below.

If you would like to contact us to exercise one or more of these rights, to ask a question about these rights or any other provision of this Policy or about our processing of your Personal Data, or to file a complaint about how we process your Personal Data, you may use the contact details provided in How to contact us below. When submitting a rights request, please specify the scope and basis of your request and provide us with the necessary information to verify your identity. We may contact you to confirm your identity in order to handle your request. We will respond to your request or complaint in due course under applicable data protection laws.

6.9. Cookies, Similar Technologies, and Targeted Advertising

If you do not want information collected through the use of cookies, you can manage/deny cookies (and certain technologies) using your browser’s settings menu. For cookies and similar technologies that are not strictly necessary for the provision of our Services, we will request your explicit consent before processing. You may revoke your consent or manage your cookie preferences at any time through the cookie banner or settings within our Services.

For certain third-party services, you may need to opt out of third-party services directly via the third party. For example, to opt-out of Google’s analytic and marketing services, visit Google Analytics Terms of Use, the Google Policy, or Google Analytics Opt-out.

6.10. Do Not Track

Our Services do not respond to your browser’s do not track signal.

6.11. Verification of Rights Requests

If you submit a request, we typically must verify your identity to ensure that you have the right to make that request, reduce fraud, and to ensure the security of Personal Data. If an agent is submitting the request on your behalf, we reserve the right to validate the agent’s authority to act on your behalf.

We may require that you match Personal Data we have on file in order to adequately verify your identity. If you have an account, we may require that you log into the account to submit the request as part of the verification process. We may not grant access to certain Personal Data to you if prohibited by law.

 

7. How do we protect minors?

Our Services are not directed toward, and we do not knowingly collect, sell, or share any information about children under the age of 18. If you become aware that a child under the age of 18 has provided any Personal Data to us while using our Services, please email us at the contact details provided in How to contact us below, and we will investigate the matter and, if appropriate, delete the Personal Data.

 

8. How do we update this Policy?

We will update this Policy in a timely manner, and we recommend that you regularly check the latest version of this Policy at the bottom of the website or via “Legal and Privacy” in the App. If there are any substantial changes to this Policy, depending on the nature of such changes, we will notify you in advance through pop-ups, push notifications, emails, and other appropriate means.

 

9. Your U.S. Privacy Rights

Some U.S. states have privacy laws providing privacy rights to their residents. These laws include the MHMDA, Nevada Revised Statutes and California Civil Code. This section outlines your privacy rights under these laws.

9.1. Consumer Health Data Privacy Policy

We do not actively collect health information from Job Seekers, Recruiters, or other users. Nevertheless, we may receive the following categories of personal information linked or reasonably linkable to a consumer and that may identify the consumer's past, present, or future physical or mental health status (“Consumer Health Data”) as defined under MHMDA and similar laws, under the following circumstances and for the following purposes:

(a)   Your Rights

Under the Washington State MHMDA and similar laws, residents, and natural persons whose Consumer Health Data is collected in certain states may have the following rights, subject to verification, exceptions, and limitations:

Right to Confirm/Access/Know: Up to twice annually, you have the right to (a) confirm whether we are collecting, sharing, or selling your Consumer Health Data, and (b) access such data, including a list of all third parties and affiliates with whom we have shared or sold the consumer health data and an active email address or other online mechanism that you may use to contact these third parties.

Right to Delete: You have the right to request deletion of the Consumer Health Data held by us and our processors, contractors, and other third parties.

Right to Withdraw your Consent/Opt-Out: You may withdraw any consent you have provided at any time.

Right to Non-Discrimination: You have the right to not to receive discriminatory treatment as a result of your exercise of rights conferred by the MHMDA and similar laws.

Washington Residents: If your appeal is unsuccessful, you can raise a concern or lodge a complaint with the Washington State Attorney General here.

Nevada Residents: If your appeal is unsuccessful, you can raise a concern or lodge a complaint with the State of Nevada Attorney General here.

9.2. Your Nevada Privacy Rights

The Nevada Revised Statutes (NRS 603A.300 et seq.) permit a Nevada consumer to direct an operator of an Internet website or online service to refrain from making any sale of any covered information the operator has collected or will collect about that consumer. If you are a Nevada consumer, you may submit a request pursuant to this directive by emailing us at [email protected]. We will provide further information about how we verify the authenticity of the request and your identity.

9.3. Your California Privacy Rights

Section 1798.83 of the California Civil Code permits California residents to request from a business, with whom the California resident has an established business relationship, certain information about the types of personal information the business has shared with third parties for those third parties’ direct marketing purposes and the names and addresses of the third parties with whom the business has shared such information during the immediately preceding calendar year.
